Terms & Conditions
These terms come from Night Sky Labs LLC, a New Jersey limited liability company ("Night Sky Labs," "we," "us"). They have three parts.
SMS Terms
Program name: Night Sky Labs Missed-Call Text-Back. These terms cover text messages sent through Night Sky Labs, including messages sent on behalf of the local service businesses that use our missed-call text-back service, and messages Night Sky Labs sends about its own demos.
Missed-call text-back messages
When you call a business that uses our service and the call isn't answered, you may receive one text message from that business asking how it can help. The message names the business. You'll receive more messages only if you reply, and those messages are about your request, such as questions about the job, scheduling and follow-up. These messages are never used for advertising.
Example: "Hi, this is Tidewell Plumbing. Sorry we missed your call. Want help by text? Reply with what you need and we'll text you back. Reply STOP to opt out."
Demo and scheduling messages from Night Sky Labs
If you check the box on our contact form agreeing to receive texts, Night Sky Labs may send you up to 5 messages about scheduling your demo. Consent is not a condition of any purchase.
Message frequency and cost
Message frequency varies based on your conversation. Message and data rates may apply. Check with your mobile carrier for details about your plan.
How to opt out
Reply STOP to any message to stop receiving texts from that number. You can also reply END, CANCEL, UNSUBSCRIBE, QUIT, STOPALL or REVOKE, or tell us in your own words, such as "don't text me." You'll receive one message confirming you've been unsubscribed and no more after that. To start again, reply START.

Carriers
Carriers are not liable for delayed or undelivered messages. Supported carriers include major U.S. carriers such as AT&T, T-Mobile and Verizon.
Privacy
We don't sell phone numbers, and we don't share mobile information with third parties or affiliates for marketing or promotional purposes. Read our Privacy Policy for details.
Service Terms
These apply to businesses that buy our services. If you sign a written agreement or order form with us, that agreement controls where it differs from these terms. Our services are for businesses only, and the person signing up must be at least 18 and authorized to act for the business.
Missed-call text-back: billing and automatic renewal
- Price: $197 per month, plus any setup fee stated on your order. Founding clients pay no setup fee.
- Automatic renewal: your subscription renews automatically every month, and the card or bank account on file is charged $197 on the same day each month until you cancel.
- How to cancel: cancel anytime from the billing portal link in your welcome email, or by calling or texting us at (862) 256-2103. We'll confirm your cancellation in writing.
- When cancellation takes effect: service continues through the end of the month you've already paid for, and you won't be charged again. We don't give partial-month refunds.
- No contract: there is no minimum term and no cancellation fee.
- Price changes: we'll tell you at least 30 days before any price change takes effect, so you can cancel before then.
- Failed payments: if a payment fails, our payment processor will retry it. If it still can't be collected, we may pause the service until it's paid.
- Carrier fees: the monthly price includes standard carrier registration fees for your business.
Websites: payment, renewal and ownership
- Preview first: we build a free preview. You pay nothing unless you approve it and choose a plan.
- Price: Standard is $299 and Premium is $499, paid once when you approve your site and before it goes live.
- Year one: your domain name and hosting for the first year are included. Changes are free for 30 days after launch, then $25 each.
- Domain renewal: your domain renews once a year at our cost from the domain registrar. We'll contact you at least 30 days before each renewal, and nothing renews without your approval. You can let it lapse or transfer the domain to yourself at any time.
- You own your domain and the content you give us, such as your logo, photos and text.
- Site files: once you've paid in full, you get a permanent right to use, change and host your finished website anywhere. We keep ownership of our reusable code, templates and tools, and we may show your finished site in our portfolio unless you ask us not to.
Your responsibilities
- Give us accurate business information, including the details carriers require for registration.
- Approve the text messages sent in your business's name, and use the service only to respond to people who contacted you, never for advertising or marketing messages.
- Don't text anyone who has opted out, including from your own phone in reply to a lead that opted out.
- Follow the laws that apply to your business and your messages.
- Have the right to use any logos, photos or text you give us.
Carrier approval and results
Mobile carriers decide whether to approve a business for texting. We'll help with registration, but we can't guarantee approval or how long it takes. We don't promise any number of calls, leads, jobs or revenue.
Availability
We work to keep the service running, but it depends on phone carriers, messaging providers and hosting providers outside our control. We don't guarantee that every call will be detected or every message delivered.
Limit of liability
To the fullest extent the law allows, our total liability for any claim related to our services is limited to the amount you paid us in the 3 months before the claim, and we are not liable for lost profits or indirect or consequential damages.

Examples
Sample websites, call logs and text conversations on this site use fictional businesses and phone numbers. Any resemblance to a real business is unintentional.
Calculator
The calculator on our home page is simple arithmetic for illustration. It is not a prediction or a promise of results.
No warranty
This website is provided "as is." Prices and features shown on it may change.
Governing law
These terms are governed by the laws of the State of New Jersey.
Changes
We may update these terms. We'll change the effective date above when we do, and we'll notify paying customers of any change that affects their price or billing.
